It is said that if a person finds an item worth Rs 10 or more on the way, he should return that item to the police or its owner, otherwise action can be taken. What exactly does the law say?
According to Delhi High Court lawyer Prem Joshi, there is a law in India known as Contract Law 1872. Section 71 of the Act deals with the duties and responsibilities of a person in respect of goods received.
It is said in this law that if a person receives someone’s goods, he should keep them properly, handle them responsibly, keep them in such a condition that they do not cause any harm. Efforts should be made to return the found item to its original owner. For this, you can take the help of police and income tax agencies.
Imprisonment for misuse of found articles
Advocate Joshi also says that there is no specific law that compels you to report anything you find on the road to the police. If someone finds something lying on the road and keeps it with him, it is not considered theft, but the person who has found it can misuse it. In such a situation, misusing the goods found under section 403 of the Indian Penal Code can be a crime. Doing so can lead to imprisonment of up to two years and fine can also be imposed.
Though there is no strict provision in the law, efforts should be made to return the article found on the road to its original owner.
